1. Introduction
These Terms of Service ("Terms") form a binding agreement between you (the "Buyer", "you") and QualiPhone (the trade name under which we operate; "QualiPhone", "we", "us"). They govern your access to and use of our website, mobile web, and any related services (together, the "Site") and any purchase of a device from us through the Site.
By creating an account, placing an order, or otherwise using the Site, you confirm that you have read, understood, and accepted these Terms together with our Privacy Policy and Refund Policy, which form an integral part of this agreement. If you do not agree, please do not use the Site.
These Terms are governed by the laws of the Arab Republic of Egypt, with particular reference to: the Egyptian Civil Code; Consumer Protection Law No. 181 of 2018 and its Executive Regulations; the E-Signature Law No. 15 of 2004; the Personal Data Protection Law No. 151 of 2020; and the VAT Law No. 67 of 2016 as amended.
2. Definitions
"Device" means any refurbished iPhone offered for sale by QualiPhone on the Site.
"Order" means an offer made by you to purchase a Device, completed once you submit checkout on the Site.
"Order Confirmation" means our electronic acceptance of an Order, which forms the binding sales contract between you and QualiPhone.
"Delivery" means the moment the courier hands the Device to you (or to a recipient at the address you supplied) and you accept it.
"Inspection Window" means the seven (7) calendar days following Delivery during which a formal dispute may be opened under our Refund Policy.
"Warranty Period" means the thirty (30) calendar days following Delivery during which the no-questions-asked money-back guarantee applies to Devices we own.
"Working Day" means any day other than Friday, Saturday, or an official Egyptian public holiday.
3. Eligibility and Accounts
To place an Order you must be at least eighteen (18) years old and have full legal capacity to contract under Egyptian law. By using the Site you confirm that this is the case.
You agree to provide accurate, current, and complete information when creating an account or placing an Order, and to keep that information up to date. You are responsible for all activity that occurs under your account, including for safeguarding your password and any one-time codes sent to your phone.
You may hold one account per person. Accounts may not be transferred or sold. We may suspend or close an account that breaches these Terms, that we reasonably suspect to have been opened with false information, or that is used to attempt fraud.
4. The Catalog and Product Information
Each Device offered for sale on the Site is owned by QualiPhone and has been inspected by us before listing. The product page shows: model, storage capacity, colour, the assigned condition grade (Mint / Good / Fair), measured battery health, the last four digits of the IMEI, and real photographs of the actual unit you would receive.
Descriptions, photographs, and condition grades are provided in good faith and reflect the device at the time it was inspected. Cosmetic differences that fall within the published condition grade are not considered defects. Where you would like additional photographs or to ask a specific question, please contact us before placing the Order.
Prices are displayed in Egyptian Pounds (EGP) and are inclusive of any applicable Value Added Tax. The price shown at checkout is the price you pay; we do not add hidden fees.
We reserve the right to correct manifest errors in pricing or specifications at any time before we issue an Order Confirmation. Where an obvious error is identified after Order Confirmation, we will contact you and offer either to honour the corrected price or to cancel the Order with a full refund.
5. Orders and Formation of Contract
Submitting an Order is an offer by you to purchase the selected Device on these Terms. The display of a Device on the Site is an invitation to treat, not an offer.
A binding contract of sale is formed only when we issue an Order Confirmation by email and/or in-app notification. Until that moment QualiPhone may decline an Order, including (without limitation) where the Device has just been sold, where stock cannot be verified, where there is reasonable suspicion of fraud, or where we cannot deliver to your address.
Upon Order Confirmation the Device is reserved to you and is removed from sale to other buyers.
All sales are concluded electronically. By submitting an Order you accept the use of electronic records and signatures as evidence of the contract under E-Signature Law No. 15 of 2004.
6. Payment, Delivery, and Risk
Payment options at checkout currently include cash on delivery and any electronic payment methods displayed at the time of Order. Where cash on delivery is selected, payment is due in full to the courier upon Delivery. Where an electronic payment is selected, settlement occurs at checkout in accordance with the payment provider's terms.
We deliver across the Arab Republic of Egypt through our logistics partners. Delivery times shown on the Site are estimates and not guarantees. QualiPhone is not liable for courier delays caused by force majeure, exceptional weather, civil disturbance, official holidays, or events outside our reasonable control.
Risk of loss or damage to the Device passes to you upon Delivery. Title to the Device passes to you upon Delivery and full payment, whichever occurs later. Until Delivery, the Device remains the property and at the risk of QualiPhone.
Delivery costs and turnaround for areas outside Greater Cairo will be shown at checkout where applicable.
7. Inspection on Delivery
You have the right to inspect the Device at the door before accepting the parcel. If the Device does not match the listing — wrong model, wrong storage, visibly different condition, IMEI mismatch, or damage in transit — you may refuse Delivery without paying any fee and without being required to give a reason. The Order will be cancelled and any sums already paid will be refunded in full.
Once you accept Delivery, the seven-day Inspection Window opens, during which you may open a formal dispute through the Site under our Refund Policy. Acceptance of Delivery does not waive any of your rights under Consumer Protection Law No. 181 of 2018 or under the Warranty described in Section 8.
8. 30-Day Money-Back Guarantee
QualiPhone offers a thirty (30) day money-back guarantee on every Device we sell. The Warranty Period starts on the day of Delivery.
During the Warranty Period you may return the Device for a full refund of the purchase price for any reason, including changing your mind. This is in addition to — and does not replace — your statutory rights under Consumer Protection Law No. 181 of 2018, including the right to a replacement, repair, or refund where a sold product is non-conforming.
The guarantee covers, without limitation: the Device not matching the published specification or condition grade; functional defects present at the time of Delivery; IMEI mismatch; battery health below the value disclosed at sale by more than five (5) percentage points.
The guarantee does not cover: physical or liquid damage caused after Delivery; modifications, jailbreaks, or third-party repairs performed after Delivery; cosmetic differences that fall within the published condition grade; accessories or third-party items not included in the sale; loss or theft after Delivery.
Return shipping is paid by QualiPhone where the return is due to misrepresentation, defect, or IMEI issue. Where the return is a goodwill / change-of-mind return within the Warranty Period, QualiPhone covers return shipping inside Greater Cairo and shares the courier fee equally with you outside Greater Cairo. Refunds are issued within three (3) Working Days of the Device returning to QualiPhone in the same channel used for the original payment.
9. IMEI and Lawful Provenance
Every Device sold by QualiPhone is checked against an internal IMEI blacklist before it is listed and again before it ships. We do not knowingly sell devices reported as stolen, lost, or otherwise restricted from the public network in Egypt.
If, after Delivery, a Device proves to have been blacklisted by a carrier or law-enforcement authority for facts predating the sale, you must notify us within five (5) Working Days of becoming aware. We will arrange collection of the Device, refund the full purchase price, and bear all return shipping costs. We will not seek any further compensation or fee from you in respect of that transaction.
You agree not to use a Device purchased from QualiPhone in connection with any unlawful activity. The IMEI history of each Device is retained for legal and consumer-protection purposes (see our Privacy Policy).
10. Acceptable Use of the Site
You agree not to: (a) use the Site in violation of any applicable law or regulation; (b) attempt to defraud QualiPhone, our payment providers, or other users; (c) submit false personal data, payment information, or delivery details; (d) reverse-engineer, scrape, decompile, or interfere with the Site or any of its systems; (e) impersonate any person or entity; (f) abuse the Warranty (for example, by claiming refunds based on facts you knew or ought to have known were false); (g) reproduce, republish, or distribute content from the Site without our prior written consent.
We may suspend access, cancel pending Orders, and take any other reasonable action where we have a good-faith belief that this clause has been breached. Where conduct rises to the level of a criminal offence, we may report it to the competent Egyptian authorities.
11. Liability and Force Majeure
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under mandatory Egyptian law, including but not limited to liability for fraud, gross negligence, death or personal injury caused by our negligence, or any of your statutory rights as a consumer under Consumer Protection Law No. 181 of 2018.
Subject to the paragraph above, and to the maximum extent permitted by law, QualiPhone's total aggregate liability arising out of or in connection with any Order is limited to the price you paid for that Order.
QualiPhone is not liable for any indirect, incidental, consequential, or punitive losses, including loss of data, loss of business, loss of profit, or loss of reputation, even where we have been advised of the possibility of such losses.
QualiPhone is not in breach of these Terms, and shall have no liability, where performance is delayed or prevented by an event beyond our reasonable control, including (without limitation) acts of government, currency or import controls, courier strikes, internet or telecommunications outages, fire, flood, or pandemic.
12. Complaints, Dispute Resolution, and Jurisdiction
If you are unhappy with anything about your Order, please first raise the issue with us through the Contact Us form or by emailing support@qualiphone.com. We aim to acknowledge complaints within one (1) Working Day and resolve them within five (5) Working Days.
If the matter cannot be resolved between us, you have the right to escalate to the Egyptian Consumer Protection Agency (CPA, جهاز حماية المستهلك) under Consumer Protection Law No. 181 of 2018. Information is available at consumerrights.gov.eg.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation are governed by the laws of the Arab Republic of Egypt. The competent courts of Cairo (and, where the dispute falls within their jurisdiction, the Cairo Economic Courts under Law No. 120 of 2008) have exclusive jurisdiction over any non-consumer claim, without prejudice to any right that you may have, as a consumer, to bring proceedings in your local court of competent jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, in applicable law, or in industry practice. The version of the Terms in force at the time you place an Order is the version that governs that Order, and any subsequent change does not retroactively affect contracts already concluded.
Material changes will be announced on the Site and, where you have an account, notified by email at least seven (7) days before they take effect. Continued use of the Site after the effective date of a change constitutes acceptance of the updated Terms for future Orders.
